But yeah it's been like that for 80% lowers for a long time. If the lower was made by another company then it's a firearm because it has a serial # and a background check has to be performed.

I could've sworn the law is if you use someone else's machines at their location then they are considered a gunsmith.As I read it and watched a show on it - I'm not so sure the guy really broke any laws. I'd have to do some more digging, but it sounds like he just helped them build their own guns and sold them the parts prior to them being a actual 100% lower. In the show I watched he had the undercover ATF agent push the button on the CNC and said he wasn't allowed to do it for them

Good to know!Last I saw it broken down is that you could not use an FFL's equipment to make a private gun. But a private party letting another private party use tools/hardware was not forbidden. They tried cracking down on build parties but ended up backing off because it would have required a huge rewrite of the FFL requirements.

Can you send an email or text message to the range owner the night before? That would be documented evidence of intent. Have the basics outlined in the message- time, location, events. All of this sent and acknowledged the day prior would be hard to dispute.
