I know with my city code, it's illegal to discharge centerfire or rimfire cartridges out of a firearm. So in my city, it would be illegal to shoot that can cannon since the lower is registered as a firearm and the blank is still a cartridge.

Hmmm, I wonder if you could shove a pipe with a nail head up through the upper to set off the blank? Then you wouldn't have a firearm discharging the cartridge...Hmmm got me thinking now lol

But one could argue it's not a firearm. The BATFE doesn't consider it one.

The lower is registered as a firearm though... unless you're talking about my pipe idea (which you'd be correct).

Yeah but what is the legal definition of a firearm? If the assembled gun was a firearm im sure it would be classified as a Destructive Device, Short barreled shotgun, AOW, etc.

You see the case in that a judge ruled that a lower is NOT in fact a firearm? ATF is losing their sh*t right now. Feds to drop weapons charges to protect gun control efforts, sources say - CNN

CNN F*cks it up but as I read between the lines - lowers are not firearms.
Wow! I did not hear about that. That guy is an idiot and got super lucky. Looks like he had a great lawyer too.
But yeah it's been like that for 80% lowers for a long time. If the lower was made by another company then it's a firearm because it has a serial # and a background check has to be performed.

As I read it and watched a show on it - I'm not so sure the guy really broke any laws. I'd have to do some more digging, but it sounds like he just helped them build their own guns and sold them the parts prior to them being a actual 100% lower. In the show I watched he had the undercover ATF agent push the button on the CNC and said he wasn't allowed to do it for them lol

Hyper-technicalities, but the laws the law lol

if one of the builders/customers didn't go on a mass shooting I bet he'd still be in the business.

Build parties happen a lot nowdays. The best part is that they dropped it so as to not draw attention to the issue with the definitions.

Yeah I saw that. I could've sworn the law is if you use someone else's machines at their location then they are considered a gunsmith.

Last I saw it broken down is that you could not use an FFL's equipment to make a private gun. But a private party letting another private party use tools/hardware was not forbidden. They tried cracking down on build parties but ended up backing off because it would have required a huge rewrite of the FFL requirements.

No, the assembled can cannon with a lower. In the eyes of the atf the lower might technically be a firearm but I don't think in this case, to local law, it can be considered a firearm. If you used a regular AR lower with a nerf gun upper is it still a firearm or is it a nerf gun? In my highly uninformed opinion This is essentially a potato cannon. Can you shoot a potato cannon in city limits?

Is it legal to shoot a potato cannon in the city? My friends and I used to shoot a massive one when we were younger

Speaking of that - I was online searching to insure I'd be legal at the pond I want to break in my new fishing pole at. Spent 2hrs looking and I'm still not sure. NY's gun laws can suck it just like NJ's can.

To be a fishing pole owner up here in the blue states you need to have a freaking law degree so you don't accidentally do something that lands you in the slammer for 5-10. All I want to do is go to a public range in NY, but I can't find a definitive answer on any gubment sites telling me I can. I can't book range time in advance (range is basically a pit in the middle of the woods w/no infrastructure) so if I get pulled over on the way there or back I have to prove where I am going to or coming from. I can easily take a pic while I'm there for the way back, but the way there I have no proof. Sucks when your state and the others around you consider you to be guilty until you prove your innocence.

Can you send an email or text message to the range owner the night before? That would be documented evidence of intent. Have the basics outlined in the message- time, location, events. All of this sent and acknowledged the day prior would be hard to dispute.

Good idea! I looked to find any sort of contact info last night and found nothing. An e-mail would be totally sufficient. Ill have to see if my buddy who has a house up there and showed me the range has any contact info. It's a free first come first serve gubment site, but I'm not sure if it's state, fed, or some weird green acres type deal because it's on a refuge. The only thing they have in place is a backstop - other than that - you are in the forest on your own. No benches, seats, etc. if someone didn't tell you it was a range no one wouldn't even know it was there.

Then I just need to confirm NY's 7 round mag ban BS.
