I talked with a friend tonight who is big into all the HAM stuff. I explained the scenario and intent to him. He said as long as we are setup to use a frequency that does not have a local repeater so we only broadcast hand radio-to-hand radio then we should be under the radar.
His wanting was that there is an entire volunteer Dept of the FCC that does nothing but monitor the airwaves for improper radio usage, illegal usage, and works to locate the parties involved for legal action. This is how those guys get their rocks off. If the actions are bad enough the FCC can confiscate all radios and any permanently mounted equipment with it.
All that said; I am going to invest a little time and money to get my general license for future use. I may or may not start using the hand radio more but at least it is an option.
So; back to planning...
I know, I know it is really good idea.
Side note; there are only few folks who can immeadiate confiscate without warrants; game wardens, Rangers, US Marshal, etc... the FCC has to get a warrant through a US Attn Office just saying.
But once you have a FCC Radio license, you just enabling the FCC the ability to come visit any time day/night for inspection of RF energy per previous court actions, they may inspect inside without warrant but they will need warrant to take the equipment.
Just food for thoughts...
